The application seeks Planned Development-Residential zoning and a seven-year vesting period. The county’s pending-applications page describes up to 309 single-family homes under a conservation option and up to 309 age-restricted homes under a senior-housing option. A separate county development summary describes 650 proposed lots: 341 conservation lots and 309 senior-housing lots.

The county record does not state whether the request was approved, rejected or deferred. It also does not identify a later decision date. A traffic study modeled a different project version with 596 homes, phased as 250 homes in 2028, 103 in 2030 and 243 in 2031. Developers have described proposed road upgrades, water-line extensions, a private sewer system and other traffic improvements. Residents have raised concerns about traffic, schools, utilities, emergency services, wildlife and the area’s rural character. The project’s final size, conditions and construction schedule remain unsettled.

The filing creates a new legal and operational decision point for MaineHealth, the hospital and residents who rely on maternity care in rural Maine. The immediate question raised by the case is whether the proposed closure can proceed while the dispute is before the courts.

There is no indication in the reporting that a court has granted or denied the plaintiff’s request. The lawsuit is therefore an effort to prevent the proposed closure, not a final ruling on whether the unit will remain open.

Because the reporting is a discovery report rather than the court complaint or docket, details about the legal claims, requested remedies and procedural posture remain unavailable in the reporting.

The Lincoln County Board of Commissioners adopted amendments to Chapter 50 of the county code effective July 1, 2026. The county announced the change July 8. The action applies through the county utility system, so it matters to Denver customers served by Lincoln County rather than representing a rule adopted by Denver itself.

Which water uses may qualify

County guidance lists several categories that may be considered for a variance during a declared Stage 2 shortage. They include fire-department training, equipment testing and firefighting readiness; activities required by a law, permit, rule or court order; correction of unsafe or unsanitary conditions; certain newly installed landscaping; pressure washing tied to health, safety or franchise compliance; and other substantially similar uses approved by county staff.

The landscaping category is limited. The county form says the sod, seed, plantings or landscaping must have been installed, or been under contract for installation, before the Stage 2 declaration. The form also includes a category for registered pressure-washing businesses operating under Stage 2 conditions while minimizing water waste and coordinating with customers.

A variance is not automatic, and submitting the form does not authorize water use before approval. Applicants must describe the requested use, proposed dates and hours, conservation measures and supporting justification. Depending on the category, the county may request permits, inspection reports, court orders, work orders, contracts, invoices, photographs or other documentation.

The process follows public concern about the effect of restrictions on water-dependent businesses. WSOC-TV reported June 25 that pressure-washing operators in Lincoln County were struggling to work under the rules, including an operator based in Denver who reported a loss of business. That report covered the situation before the county adopted the new process.

County staff can approve, limit or deny a request

The Public Utilities Manager or a designee may approve a request, approve it with conditions, or deny it. Conditions can limit the days, hours, duration or volume of water use, and the county may require supporting documentation. An approved variance can be revoked if its conditions are violated or if continued use conflicts with the applicable shortage stage.

The county’s variance form asks for the applicant’s contact information, the service or property address, the requested category, the dates and hours of use, and evidence supporting the request. The form says applicants may submit it in person or by email and should allow up to 10 calendar days for processing.

Appeals have a 10-calendar-day deadline

An applicant may appeal a denied request, conditions placed on an approval, revocation of a variance or a civil-penalty assessment. The written appeal must go to the Development Services Director within 10 calendar days of the written decision. Filing an appeal does not suspend the underlying water restrictions unless the director expressly grants that relief.

Stage 2 restrictions remain in effect

North Carolina’s Division of Water Resources lists the Lincoln County water system as under mandatory drought-related conservation status, with the system’s listed status dated May 4, 2026. County guidance says Stage 2 restrictions remain mandatory until the shortage declaration is rescinded.

The restrictions prohibit or limit activities such as filling swimming pools, washing vehicles with nonrecycled water, washing down outside areas and other unnecessary or wasteful uses. They also include limits on certain landscape watering and other water uses described in the county’s Stage 2 guidance.

Any variance remains subject to the Catawba-Wateree Low Inflow Protocol. County guidance says a variance may not conflict with mandatory reductions, minimum flows or reservoir-elevation requirements under that regional drought-management framework.

Denver residents, contractors, businesses and public-safety agencies should continue following the Stage 2 rules unless and until the county approves a variance for a specific use. The county’s water-conservation guidance and administrative variance request form are the starting points for anyone who believes a narrowly defined need may qualify.
