GKN proposal sets $100 million cap for evacuation claims
A proposed settlement between GKN Aerospace and the Orange County District Attorneyโs Office would provide up to $100 million for qualifying claims tied to the May 2026 Garden Grove hazardous-materials incident. The proposed claims period could end before its scheduled closing date if approved payments reach that $100 million cap. The agreement still requires court approval, and the claims program is not open.
The District Attorneyโs Office said the civil complaint and proposed stipulated settlement were filed in Orange County Superior Court on October 12, 2026. A judge may approve or modify the agreement; none of its terms take effect before approval.
Proposed payments and monitoring
| Proposed provision | Amount or term |
|---|---|
| Claims program | Up to $100 million |
| Emergency-response and abatement costs | $8,471,385.50 |
| Civil penalties | $15 million |
| Repayment of county discretionary funds | $500,000 |
| Outside monitoring | $1.4 million; at least seven years |
The District Attorneyโs Office describes the proposal as a $125 million agreement. The five listed amounts total $125,371,385.50 if added together; the $100 million claims amount is a maximum, not a guaranteed payout. An independent third party would administer the proposed claims program.
The proposed exhibit lists individual and household losses such as lodging, transportation, meals, lost wages and loss of use. It also includes evacuation-period lost profits for businesses that meet its proposed eligibility terms. The agreement would fund an outside expert to monitor GKN operations for at least seven years.
Eligibility and proposed intake dates
The proposed rules tie individual and household eligibility to a usual residence in an evacuation zone and displacement from that residence. Claimants would have to document that they evacuated when ordered. Businesses would need a physical location in an evacuated area. Garden Groveโs incident information lists Buena Park among the affected cities, and some Buena Park residents were reported as affected or subject to evacuation orders. That does not establish that any particular resident qualifies; living in Buena Park alone is not enough.
The claims-program exhibit proposes intake from October 19, 2026, through April 19, 2027, if the court approves the agreement before October 19. That period would end earlier if claims reach $100 million in approved payments. The exhibit defines an approved payment as an accepted offer and, if GKN requires it, an executed release. If approval has not occurred before October 19, the proposed schedule would start two weeks after approval and run for six months, subject to the same early-ending threshold. These are conditional terms in a proposed document, not confirmation that applications have opened.
The District Attorneyโs Office estimates that 13,000 to 17,000 households were evacuated during a five-day period beginning May 21, 2026, and that more than 50,000 residents were forced to evacuate. GKN said it would open the program within days if the court approved the proposal. Garden Grove and GKN scheduled a community event for October 27, 2026, and said application and assistance details would be forthcoming.
