• Five residents or groups that filed appeals will each give a 12-minute presentation. Appellants can cede time to each other if they don’t need the full 12 minutes.
• Raeden (the applicant) will give a presentation for up to one hour.
• After presentations, commissioners will have time for questions and discussion.
• Public comment is expected to be time-split: up to three hours for residents opposing the data center, followed by up to three hours for supporters.
• Closing rebuttal: both the appellants and Raeden will have an opportunity to provide closing rebuttal comments before final discussion and a vote.

The ground rules also set expectations for conduct during the hearing, including that disrespectful behavior, speaking out of order, and profanity will not be tolerated.

A starting time is expected to be announced soon, and the city said additional details—such as how to sign up for public comment and watch online—will be provided in the coming days.

Background: why the appeal is at the Planning Commission stage

Colorado Public Radio reported that the City Planning Department reviewed Project Taurus using an administrative track, which can bypass the earlier public hearing steps with the Planning Commission or City Council unless the decision is appealed.

With an appeal filed, the administrative decision can move forward through the city’s appeal process—starting with the Planning Commission special appeal hearing scheduled for July 23.

In the city’s Planning Commission agenda materials, the item is described as appeals of an administrative decision connected to the Project Taurus development on an approximate 21.96-acre site at 1565 High Tech Way.

What comes next after the Planning Commission

Under Colorado Springs’ zoning code appeal procedures, decisions by the Planning Commission can be further appealed to City Council, unless the matter is remanded back to the original decision-making body.

The code also describes that, depending on the situation, an appeal hearing may be handled as de novo or limited to matters raised on appeal, and the appellate body can take actions such as affirming, reversing, modifying, or remanding.

In other words: the July 23 Planning Commission hearing is the next step now, but what happens after it will depend on what the Commission decides and whether further appeals are filed.
