EPA proposes new public participation minimums for “minor” air permits—comment deadlines

EPA published a proposed rule on July 7, 2026 that would change the federal “minimum” public-participation requirements for minor New Source Review (NSR) preconstruction air permits administered through state implementation plans (SIPs). If finalized, the federal floor that currently pushes states and local air agencies toward notice-and-comment steps for many smaller industrial projects could be reduced or removed—depending on each jurisdiction’s SIP rules.

What EPA is proposing to change

In the proposal, EPA targets the federal minimum public-participation requirements for state and local minor NSR preconstruction programs in EPA-approved SIPs under 40 CFR 51.161. EPA would revise those minimum requirements so that public notice and an opportunity for public comment would no longer be a federal “minimum” feature for minor NSR in the SIP context.

In plain terms: states and local air agencies would still have room to require public involvement, but they would be choosing that level locally rather than meeting a uniform federal minimum.

Who gets discretion, and what happens to existing SIPs

If the rule is finalized as proposed, states and local air agencies would be allowed, but not required, to revise their existing SIP-approved minor NSR public-participation provisions through the SIP process.

EPA also says that if an air agency chooses not to revise, the existing SIP public-participation requirements would remain in place and continue to apply.

What this does (and doesn’t) cover

EPA is focusing on minor NSR public-participation rules in SIPs. This proposal does not revise the public participation minimums for major NSR programs (including PSD and NNSR) or the public participation requirements for Title V operating permit programs.

EPA also flags a potential downstream consequence: changing minor NSR participation rules could affect the level of scrutiny that can occur through Title V oversight mechanisms.

Deadlines and the scheduled hearing

This is a proposed rule, not a final change. The public comment deadline is August 21, 2026. Comments are submitted through docket EPA-HQ-OAR-2025-1212.

EPA scheduled a virtual public hearing for July 22, 2026, but it is conditional: EPA says it will hold the hearing if someone requests one on or before July 12, 2026. If held, the hearing would run from 10:00 a.m. to 4:00 p.m. Eastern Time, and the last day to pre-register to speak is July 19, 2026.

What to watch next for your area

Until your state or local air agency revises its SIP (if it chooses to), the practical question is simple: will your jurisdiction keep its current public notice/comment steps for minor NSR, or will it adjust them after EPA’s proposal?

Because the timing and procedures are set in each SIP, residents who want a formal chance to comment may need to watch for state/local SIP updates and, if available, any public outreach channels that replace what might be reduced under the federal minimum.
