OSHA cites FleetPride after worker asphyxiation—what workers can do

On July 15, 2026, federal OSHA cited FleetPride Inc., alleging 16 serious safety violations and three “other-than-serious” violations after a worker asphyxiated while inspecting a tanker trailer at the company’s Corpus Christi, Texas facility. OSHA said it initiated its inspection on Jan. 7, 2026, and proposed penalties totaling $264,380. OSHA emphasized the penalties are proposed—not final—until the company follows the agency’s next-step process.
For workers nationwide, the case is a practical reminder of how OSHA expects employers to manage permit-required confined spaces—including both the employer’s overall permit-space program and the day-to-day permit controls used before anyone enters.
What OSHA says FleetPride failed to address
In its news release, OSHA highlights three hazard areas tied to the citations:
- Confined-space program gaps
- Respiratory-protection program element gaps
- Electrical hazards
Why permit-required confined spaces are so tightly regulated
OSHA’s permit-required confined spaces rule (29 CFR 1910.146) lays out a framework employers are expected to follow—starting with whether permit spaces exist, and continuing through how entry is controlled.
At a high level, 1910.146 expects employers to:
- Evaluate the workplace to determine whether any spaces are permit-required confined spaces.
- If permit spaces exist, inform exposed workers about the existence and location of those spaces and the dangers posed—through danger signs or another equally effective method.
- Run a permit space program that includes measures to prevent unauthorized entry, identify and evaluate hazards before employees enter, and set up safe entry procedures (including isolating the permit space and specifying acceptable entry conditions).
- Use safe entry controls such as purging, inerting, flushing, or ventilating as necessary to eliminate or control atmospheric hazards.
- Use a permit system by preparing an entry permit documenting the completion of required pre-entry measures and requiring the entry supervisor’s authorization before entry begins.
FleetPride’s next steps after OSHA’s citations
OSHA’s release says the company has 15 business days from receipt of the citations and penalties to take at least one of these actions: comply, request an informal conference with OSHA’s Area Director, or contest the findings before the independent Occupational Safety and Health Review Commission (OSHRC). OSHA also directs the public to check its establishment search page periodically for any changes in the inspection or penalty status.
What workers can do: file a confidential OSHA complaint
OSHA’s worker guidance explains that employees (or a representative) have the right to file a confidential safety and health complaint and request an OSHA inspection if they believe there is a serious hazard or if they think the employer is not following OSHA standards. OSHA says complaints should be filed as soon as possible after noticing the hazard, and that a signed complaint is more likely to result in an onsite inspection.
OSHA also describes multiple ways to submit:
- File online using OSHA’s online complaint form
- Fax, mail, or email the OSHA complaint form (or a letter) to your local OSHA office
- Call your local OSHA office (or OSHA’s main number)
