Jersey City hospital appeal keeps Heights site and closure process unsettled
Hudson Regional Health has given notice of an appeal after a Hudson County Superior Court judge dismissed its challenge to New Jersey’s formal closure process for Heights University Hospital, keeping the legal and regulatory dispute active while the former Jersey City hospital remains closed.
HRH gave notice of appeal on July 2, 2026, according to Hudson County View. As of that outlet’s July 13 report, HRH had not yet formally filed its appellate brief. The notice challenges rulings by Hudson County Superior Court Assignment Judge David Katz, who denied HRH’s request for restraints against the state and dismissed the complaint for lack of jurisdiction.
The appeal is pending. It does not reopen the hospital, approve a replacement facility or decide whether New Jersey’s certificate-of-need process will ultimately authorize a closure.
The former Heights hospital remains closed
Heights University Hospital, formerly known as Christ Hospital, is at 176 Palisade Avenue in Jersey City’s Heights section. The facility has not operated since March 14, 2026.
The physical closure is separate from the state’s regulatory process. HRH’s April 13 letter to the New Jersey Department of Health says the operator suspended Heights’ operations in November 2025 and later sought to withdraw its certificate-of-need application for closure. The letter says the application had been deemed complete by the department on March 20, 2026.
HRH’s lawsuit sought to halt or delay the state process. Judge Katz first denied preliminary restraints on June 18. At a June 24 hearing, he also denied intervention by the property’s landlord and granted the state’s motion to dismiss the complaint for lack of jurisdiction, according to Hudson County View.
State hearing remains canceled
The Department of Health canceled a State Health Planning Board public hearing scheduled for April 15, 2026, at William L. Dickinson High School in Jersey City after a temporary restraining order was filed in Hudson County Superior Court on behalf of Heights University Hospital.
The department’s 2026 public-hearing schedule still lists the Heights closure hearing as canceled. The department’s cancellation notice says the hearing was canceled because of the temporary restraining order. No replacement hearing date appears on the current schedule.
That is a procedural status, not a reopening announcement and not a final determination that the closure has been approved. The appeal and the state health-planning process remain separate from the fact that the hospital building is not operating.
HRH has discussed relocation, but no project is approved
In its April 13 letter, HRH said it was evaluating options that included potentially relocating the facility to another site. The company said it had engaged the facility’s landlord and the City of Jersey City about construction of a new facility and was seeking financing.
HRH also said it intended to maintain Heights’ certificate of need and general acute-care hospital license while it evaluated the facility’s future. The letter says the company would notify the department and, if applicable, file another certificate-of-need application after making a decision.
Those statements describe HRH’s position and possible plans. They do not establish that a relocation, new hospital or replacement facility has been approved, financed or scheduled.
Jersey City’s separate access debate
Jersey City officials have pursued their own response to the loss of hospital services. The April 23 minutes of the New Jersey Health Care Facilities Financing Authority say the City Council unanimously passed a resolution directing the Planning Board to examine the closed Heights site and provide recommendations that may include acquiring the property through eminent domain for a public hospital.
The minutes describe an examination and possible recommendation, not an acquisition. The approved records do not show that Jersey City has taken ownership of the property, authorized a replacement hospital or secured financing for one.
For residents, the immediate position is unchanged: the former Heights hospital at 176 Palisade Avenue is closed. The appeal keeps the court dispute active, while the canceled state hearing leaves the certificate-of-need matter without a new hearing date on the current schedule. The next meaningful developments are likely to come through the appellate court, the Department of Health and any further city action—not from the appeal itself serving as a reopening announcement.
