Nyack adopts resolution to revise cannabis-dispensary zoning rules
The Nyack Village Board adopted Resolution 2026-118 to revise the village’s zoning rules for cannabis dispensaries, a change that could affect where dispensaries may locate and how distance restrictions are applied.
The resolution amends Chapter 360 of the Village of Nyack zoning code. It would repeal Local Laws 2 and 7 of 2025 and refer the village to New York State’s preemptive regulations and laws concerning proximity distances for cannabis dispensaries.
What the resolution changes
The action does not approve a dispensary or establish that one will open in Nyack. The official resolution listing also does not provide the exact distance standards that will apply after the amendment.
Those details matter to prospective dispensary applicants, neighboring property owners and businesses involved in local commercial planning. The change could affect how proposed locations are evaluated, but the available village listing does not say that local cannabis restrictions have been eliminated.
The listing identifies the measure as Resolution 2026-118 and describes the repealed measures as Local Laws 2 and 7 of 2025. It does not show the vote date, the vote tally or the full text of the resolution.
Other 2026 village developments
The village’s May 14, 2026 current-news announcement separately reported that Gov. Kathy Hochul awarded $4.5 million in New York Forward grants to 10 recipients in Nyack. That grant announcement is separate from the cannabis-zoning action.
The same village news page listed a Feb. 20, 2026 special meeting to award a contract for the Memorial Park Shoreline Pathway Project. The page does not establish a connection between that meeting, the grant announcement and the zoning resolution.
In another separate matter, a June 10, 2026 environmental notice from the New York State Department of Environmental Conservation said the Village of Nyack Planning Board, acting as lead agency, determined that a proposed two-lot subdivision at 11 Fourth Avenue would not have a significant adverse environmental impact if specified conditions are met.
That preliminary environmental determination concerns the Fourth Avenue subdivision and is not identified as part of the cannabis-dispensary zoning amendment.
What remains unclear
The available official materials do not state when the board voted on Resolution 2026-118 or how individual members voted. They also do not spell out the practical distance requirements that will govern dispensary locations under the amended code and applicable state rules.
For now, the confirmed change is the village’s adoption of a resolution to repeal the two 2025 local laws and defer to New York State’s preemptive cannabis regulations on proximity distances.
