CPSC Plans Nationwide Upgrade to Consumer Injury Tracking
The U.S. Consumer Product Safety Commission is replacing its decades-old injury-surveillance system with a modernized network intended to give the agency broader and faster signals about consumer-product hazards.
In a July 22, 2026 announcement, the CPSC said the new system, called NEISS-Remodel or NEISS-R, is expected to become fully effective by the beginning of 2027. The agency’s planning documents show that the legacy system will continue operating during the transition.
What NEISS does
The National Electronic Injury Surveillance System uses a nationally representative probability sample of hospital emergency departments to estimate the number of consumer-product-related injuries occurring across the United States. Participating hospitals report relevant emergency-department cases, and the CPSC uses the sample to produce national estimates.
Those estimates help researchers and CPSC staff study hazards and evaluate whether warnings, recalls or enforcement action may be warranted. NEISS is a surveillance system, not a feed of every emergency-room visit in the country.
The CPSC says the legacy model was designed in 1972 for a paper-record era and relies heavily on manual review and coding of records from roughly 70 hospitals. The agency also says 14 states do not have participating hospitals in the current network, creating geographic gaps in the sample.
What NEISS-R is intended to change
The planned replacement would expand the surveillance network to hospitals in all 50 states, including areas the CPSC identifies as previously underrepresented or missing, such as Alaska, Hawaii, the Mountain West and northern states.
The agency also plans to replace much of the manual process with standardized electronic data exchange using electronic-health-record infrastructure. CPSC officials say that could help analysts identify rare or rapidly emerging hazards sooner, including injury patterns that initially appear small or concentrated in a particular region.
Earlier signals could give the agency more time to investigate products and consider warnings, recalls or enforcement action. NEISS-R would not automatically produce a recall or prevent an injury; it is intended to improve the evidence available for those decisions.
Privacy claims will be tested during implementation
The CPSC says NEISS-R will exchange information through a Qualified Health Information Network and use contractual privacy requirements, standardized security safeguards, data minimization and de-identification before information reaches the agency.
The planned system also uses a cloud-based architecture connected to the CPSC’s broader data-modernization work. The agency says the design should reduce manual handling of sensitive records and limit collection and retention to information needed for its statutory mission.
Those are agency-stated safeguards, not an independent finding that the system has already demonstrated its privacy or performance. Independent reporting has raised questions from hospital lawyers and experts about participation, legal authority and the handling of medical information. Those concerns should be understood as implementation questions and reported objections, not final legal findings.
Why the transition matters
A CPSC mid-year planning memo shows that the agency is funding both sides of the transition. It lists continued manual NEISS data collection for July through December 2026 and a project to expand electronic-health-record work to 100 integrations.
The memo says the manual work is intended to maintain uninterrupted national injury surveillance while the agency moves toward EHR-based collection. The transition therefore is not evidence that NEISS-R is already fully operational or that nationwide electronic coverage has been achieved.
For consumers, there is no immediate change in how unsafe products or product-related injuries are reported or how recalls are checked. The existing NEISS query system remains available, and the CPSC says data for 2025 treatment dates were available for query and download as of May 7, 2026.
The practical test will come after implementation: whether NEISS-R produces timely, reliable and privacy-protective information from areas previously missing or underrepresented in the sample, and whether that information helps the CPSC identify hazards early enough to support effective warnings or recalls.
