The House Judiciary Committee announced a subpoena on July 15, 2026 demanding that Philadelphia District Attorney Larry Krasner turn over immigration-related records by July 29, 2026.
What Congress says it wantsโand why the clock matters
In its July 15 notice, the committee said it escalated from earlier requests after Krasnerโs office did not provide materials requested in May. The subpoena directs Krasner to produce the requested information by July 29, 2026.
The earlier request came in a May 4, 2026 letter from Rep. Jim Jordan and the House Judiciary Committeeโs immigration subcommittee, which asked for documents covering January 1, 2018 to the present. That letter set a response deadline of May 18, 2026, at 5:00 p.m.
Record categories in the May 4 request
Congress listed multiple categories of immigration-related communications and records, including:
- Documents and communications about the DAโs officeโs interaction with Immigration and Customs Enforcement (ICE).
- Records tied to the DAโs policies for prosecuting non-U.S. citizens.
- Cases reviewed or consulted by the DAโs Immigration Counsel, including defendantsโ initial charges and case dispositions.
- Instances where the DAโs office overcame a policy presumption related to not seeking an immigration-neutral outcome.
- Policies related to bond for non-U.S. citizens.
- Communications between the DAโs office, the Philadelphia Police Department, and the Philadelphia Sheriffโs Office about immigration enforcement.
How Krasnerโs office disputes the framing
In a May 13, 2026 response, Krasner criticized the committeeโs characterization and argued that the House Judiciary Committee is overreaching into local prosecutorial authority. The DAโs office cited the 10th Amendment and the Commandeering Doctrine, saying Congress cannot control what local prosecutors do in relation to ICE and immigration policy.
Why this could matter nationwide
Although the subpoena targets Philadelphia, Congress is using a document-demand approachโnot only hearings or lettersโto press local prosecutors over how they handle immigration-related issues. If this record request is enforced or otherwise becomes a model, other jurisdictions watching the fight could adjust how they document decisions and communications involving federal immigration enforcement.
What to watch next
The next checkpoint is July 29, 2026: whether Krasnerโs office complies, negotiates what must be produced, or instead challenges the subpoena in court.
