Miner Lake sewer petition effort suspended after not hitting threshold

A petition effort tied to sewer expansion at Miner Lake has been suspended after organizers say it fell short of a key threshold needed to formally request a Sewer Special Assessment District in Allegan Township.

In a June 27 update, the Miner Lake Sewer Task Force told the Allegan Township Board that the petition to request creation of a Sewer Special Assessment District is being paused because the signatures collected represented more than 40% of the proposed district’s land area—below the “more than 50%” land-area requirement.

What the petition was asking for, and why it stalled

The task force says the proposed Sewer Special Assessment District would have required petition signatures from property owners representing more than 50% of the land area within the proposed district.

According to the update, organizers collected signatures from more than 100 parcels, representing more than 40% of the proposed district’s land area. The task force says this level of support was significant, but it was not enough to formally request that the Allegan Township Board begin the hearing process for formation of a Special Assessment District.

Because the petition effort has been suspended, residents who were expecting the hearing process to move forward are now in a pause-and-watch phase—at least for now. The task force’s statement is about suspending the petition effort, not a final promise about what the Township Board will do next.

Why residents pursued sewer planning at Miner Lake

The task force says the sewer push grew out of concerns about onsite wastewater conditions around Miner Lake. In its update, the group points to soil conditions around the lake, limited lot sizes, and the lack of complete documentation for many existing septic systems.

It also cites water-quality concerns, describing the area as eutrophic and noting the growth of aquatic plants and algae.

On the Miner Lake sewer project page, the effort is framed around the limits of individual septic systems—describing septic systems as “not ideal” and saying aging or undersized septic systems built on poor-quality soil are having a negative impact on lake conditions.

How special assessments work in Allegan County (benefit-based)

Allegan County’s Drain Office says the law requires special assessments be based on the benefit derived, as determined by the Drain Commissioner.

In its special assessment FAQs, the Drain Office lists factors that can affect how assessments are calculated within a drainage district, including parcel size, land use, proximity to the drain, and the location of the property within the district.

What to watch at the July 6 Allegan Township Board meeting

The task force says it will deliver an in-person update at the July 6 Board meeting. For residents, the key question will be whether the Board discusses next steps—if any—or whether the matter stays paused while residents consider other information and options.

Timing if assessments are proposed later

Allegan County’s Drain Office FAQs also provide a reader-facing reminder for property owners: the Drain Office says an appeal of Drain Special Assessments may be made to Allegan County Probate Court within 10 days after the Day of Review.

That appeal window would only apply if/when proposed assessments reach the Day of Review stage—something residents may not see during this current suspended petition phase.

For now, the immediate takeaway is straightforward: the task force says it suspended the petition because the signature share didn’t reach the “more than 50% of land area” threshold, and the July 6 Township meeting is where the public update is expected to happen next.
