Seventh Circuit grants en banc review, stays AAP injunction

What changed in the Seventh Circuit on July 8

The July 8 order did three procedural things at once:

• Granted the request for en banc reconsideration.
• Vacated the earlier June 22 panel opinion.
• Stayed the district court’s preliminary injunction pending resolution of the appeal and issuance of the Seventh Circuit’s mandate.

Practically, that means the district court’s temporary block is paused while the case moves forward through initial en banc review.

Who’s affected while the stay is in place

AAP’s ability to rely on that preliminary injunction to halt the Florida enforcement case is on hold during the en banc proceedings. For now, Uthmeier’s state court action is not blocked by the stayed federal preliminary injunction.

The Seventh Circuit said it will set a new briefing schedule and a date for oral argument by separate order.
