Deputy critically injured in Sioux Falls shooting; six charges filed
A Minnehaha County Sheriff’s Office deputy was critically injured in a shooting at a Sioux Falls home on Friday, Oct. 9, 2026. Brandon Oetken, 39, was charged with six counts related to the incident, and the South Dakota Division of Criminal Investigation is conducting an independent use-of-force investigation.
The Attorney General’s Office announced the investigation on Oct. 10. Dakota News Now reported that the deputy was hospitalized in critical condition and that Oetken was also injured and taken to a hospital.
Deputies arrived after an evening call
Local reporting placed the shooting in the 2900 block of South Keyrell Drive. The Dakota Scout reported that deputies were dispatched after a call for service at about 7 p.m. and arrived around 7:30 p.m. Dakota News Now reported that shots were fired about 30 minutes after deputies arrived.
The Dakota Scout reported that three deputies were at the location. Officials had not publicly disclosed the reason for the initial call, according to that report. The Attorney General’s Office confirmed the shooting occurred at a Sioux Falls home but did not provide a public account of the sequence leading to the gunfire in its announcement.
Charges and state investigation remain pending
The Minnehaha County State’s Attorney’s Office charged Oetken with three counts of attempted first-degree murder of a law-enforcement officer and three counts of aggravated assault of a law-enforcement officer. The charges are allegations; Oetken is presumed innocent unless proven guilty.
The Minnehaha County Sheriff’s Office requested an independent investigation by DCI, which is leading the inquiry with assistance from Sioux Falls Police. The investigation will examine the use of force. No final finding on the officers’ actions has been announced, and the criminal charges remain pending.
DCI is to submit a final report to the Attorney General for review. The Attorney General’s Office said on Oct. 10 that public release of the report was anticipated within 30 days. That was an expected timeframe, not a confirmed release date.
The deputy’s critical condition was reported on Oct. 10. The public announcement and local accounts cited here identify the deputy by agency, not by name. The investigation and the criminal case are separate pending matters: the state review concerns use of force, while the charges against Oetken have not been decided in court.
