NHTSA Reviews Tesla Cybercab Self-Certification After Austin Launch
Federal regulators are reviewing Tesla’s self-certification of its steering-wheel-free Cybercab, one day after the company began offering limited commercial rides in Austin, Texas.
The National Highway Traffic Safety Administration said on September 4, 2026, that it had opened an Audit Query to examine the technical data, processes and regulatory conclusions Tesla used to certify the vehicle under existing Federal Motor Vehicle Safety Standards. The review could affect how quickly Tesla expands its robotaxi service and how other companies bring similar vehicles to U.S. roads.
What NHTSA is examining
NHTSA said the Audit Query will assess the basis for Tesla’s claim that the Cybercab complies with all applicable federal safety standards. The agency is examining whether Tesla’s compliance framework treated some requirements as inapplicable to a vehicle without traditional human controls.
According to NHTSA and Reuters, the Cybercab lacks a steering wheel, brake pedal, accelerator pedal and mirrors. Those design features are central to the regulatory question because current federal standards remain in force while the agency considers proposed changes for automated vehicles.
NHTSA’s action does not establish that Tesla violated federal law, that the Cybercab is unsafe or that Austin service must stop. It is a review of the company’s certification basis.
Austin launch brought the issue into focus
Tesla began commercial deployment of a small number of two-seat Cybercabs in Austin on September 3. The launch was presented as the beginning of a broader expansion, but the initial service is not a nationwide rollout.
The Associated Press reported that Tesla sent dozens of the vehicles onto Austin streets and described plans for a national robotaxi rollout. Tesla had not responded to requests for comment in the AP and Reuters reports reviewed for this article.
Reuters reported that the NHTSA inquiry could cover up to about 1,000 Cybercabs. That is an approximate scope reported by Reuters, not a final vehicle count specified in NHTSA’s announcement.
How vehicle self-certification works
Automakers generally certify that new vehicles comply with federal safety standards before placing them on the U.S. market. NHTSA does not preapprove every vehicle, but it can audit or investigate certifications when a vehicle appears not to meet applicable requirements.
Federal law also gives NHTSA authority to grant limited exemptions for vehicles that cannot meet certain requirements for conventional human controls. Reuters reported that the agency can approve petitions covering up to 2,500 vehicles per manufacturer each year. In July, NHTSA approved an exemption for Amazon’s Zoox unit for limited commercial deployment of steering-wheel-free robotaxis.
Reuters also reported that Tesla had not petitioned NHTSA for an exemption. That report does not establish why Tesla did not file one or whether the company’s self-certification will ultimately be accepted.
Why the timing matters
The review comes as the Transportation Department pursues a national automated-vehicle strategy focused on safety oversight, regulatory modernization and broader commercial deployment. NHTSA said it has begun rulemakings involving equipment such as brake pedals, windshield wipers, lighting and rearview mirrors.
Those proposed changes could eventually make it easier to certify vehicles designed without traditional driver equipment. Until any changes are finalized, however, NHTSA says the existing standards remain in force.
For Tesla, the immediate question is whether its paperwork, testing and interpretation of those standards support its Cybercab certification. For other robotaxi developers, the outcome could help clarify when steering-wheel-free vehicles must use the exemption process and how automated vehicles should be evaluated under the rules currently in effect.
