A Jefferson County Circuit Court hearing over the Nebius data-center project in Birmingham’s Oxmoor Valley is scheduled to resume August 12 after two days of testimony and arguments in July.
The case concerns whether construction should be paused while nearby residents’ broader lawsuit moves forward. The court has not issued a final ruling on the project, and the July 10 order allowing the lawsuit to proceed did not decide whether Birmingham’s permits or zoning interpretation were valid.
What the court is deciding now
The immediate issue is the residents’ request for a preliminary injunction. Such an order could suspend or restrict construction while the court considers the larger legal dispute. The August 12 date is a continuation of the preliminary-injunction hearing, not a scheduled final decision in the case.
According to WBHM’s reporting, the hearing began July 14 and continued July 16. Arguments and testimony addressed the city’s permitting decisions, the interpretation of Birmingham’s zoning rules, and concerns raised by nearby homeowners about potential construction effects. Those concerns are allegations and claims in the litigation, not findings the court has adopted.
Why the permits and zoning rules are disputed
The residents’ verified complaint, filed in the case identified as Sansome v. Hoar et al., challenges the legal basis for the project’s approvals and seeks several forms of relief. The requested remedies include injunctions, declarations concerning the permits, and other action by the court. None of those outcomes has been granted.
The central dispute includes which zoning standards governed when the project received its permits. Birmingham’s position is that the Nebius project was permitted under the rules in effect before the city adopted new data-center regulations.
That timing matters because the City of Birmingham approved a new data-center ordinance on June 9. The ordinance establishes additional community protections for data-center development, but the city disputes that the newer requirements automatically apply to the Nebius project already under litigation. The court will have to address how the newer policy relates to the earlier permits and the claims raised by the residents.
What happens next
The next major date for the case is August 12, when the preliminary-injunction hearing is expected to continue in Jefferson County Circuit Court. The court could later rule on whether construction may continue during the lawsuit, but the timing and substance of any ruling remain undecided.
For nearby homeowners, the immediate question is whether the project’s construction schedule will face a court-ordered pause or restriction. For Birmingham officials and developers, the case also puts the city’s earlier zoning interpretation alongside its newer data-center rules. A decision on the injunction would address the project’s near-term status, but it would not necessarily resolve the full lawsuit.
