Delray Beach Approves Townhome Use With Zoning Waivers
The Delray Beach City Commission approved a conditional use for freestanding multiple-family housing in a general-commercial zoning district on July 14, 2026, allowing a proposed townhome project to move forward under a set of site-specific development waivers.
The decision, adopted through Resolution 96-26, changes several requirements that will govern how the residential development can be arranged. The approved waivers cover townhome spacing, building separation, internal vehicle circulation, driveway buffers, fencing and loading accommodations.
The action creates a land-use framework for multifamily housing on property zoned for general commercial activity. It does not identify the projectโs total number of homes or set a construction schedule.
What the commission approved
One of the most significant waivers allows a zero-foot offset between townhomes. The approval also permits decorative fencing within a special landscape setback, changing how the project may use that setback area for its perimeter design.
For vehicles, the commission approved a 22-foot-wide drive aisle and a three-foot buffer between driveways. Those dimensions will shape internal circulation and the amount of space separating driveway access points within the development.
The resolution also includes two minimum building-separation measurements. Residential buildings may be separated by 25 feet in one applicable portion of the layout and by 12 feet 4 inches in another.
Commissioners further approved the adequacy of the proposed loading accommodations. That decision addresses how loading activity will be handled as part of the projectโs site plan.
Why the approval matters
The commissionโs vote is more than a general zoning decision. It combines approval of a residential use with several dimensional adjustments that affect the projectโs potential layout, circulation and relationship to landscaped areas.
Allowing freestanding multifamily housing in a general-commercial district gives the proposed development a permitted land-use path that would not otherwise be available under a commercial-only framework. The waivers also provide the specific measurements under which the townhomes, drive aisles, driveways, fencing and buildings may be arranged.
For residents tracking development in Delray Beach, the practical significance is that the project has cleared the conditional-use decision before the City Commission. The approved dimensions provide a clearer picture of the site-design standards that will apply if the project advances through later development steps.
What remains ahead
Resolution 96-26 establishes the approved conditional use and the related waivers, but the city record does not set a construction start date. It also does not establish whether construction permits have been issued.
The July 14 action therefore defines the projectโs approved land-use parameters without establishing its final scale or timing. The number of homes, construction schedule and later permitting activity will depend on subsequent project filings and city approvals.
