Fresno City Council voted Oct. 22, 2026, to approve a resolution to reestablish the cityโs Immigration Legal Defense Fund. The resolution directs the City Manager to allocate $1 million through the FY 2027 midyear budget process, subject to available funds and any necessary appropriations.
The vote does not establish that the money has been appropriated or spent. The resolution assigns administration to the City Attorneyโs Office and calls for immigration-related legal services for eligible Fresno residents through qualified outside providers.
Funding and eligibility terms
The proposed $1 million is five times the $200,000 Fresno allocated toward an immigrant legal-defense fund in 2021, according to Fresnoland. The comparison is by dollar amount, not funding status: the earlier figure was reported as an allocation, while the new amount remains conditional on the midyear budget process and any required appropriations.
The resolution refers to eligible residents but does not specify eligibility criteria. Fresnoland reported that an amendment limited eligibility to Fresno residents without a criminal conviction; that restriction does not appear in the attached resolution text, so the final eligibility wording is not confirmed there.
Vote and approval status
The city lists action item 26-1400 as approved on the consent calendar. The meeting record reports five votes in favor and one against, with one councilmember absent: Nick Richardson voted no and Tyler Maxwell was absent. That tally is for the consent-calendar package, not a separately recorded roll call on this item.
Fresnoland reported that 17 speakers urged approval and two spoke against the fund. One supporter cited the lack of court-appointed counsel in immigration court and possible consequences for detained residents and their families. One opponent argued that the fund would give a special legal benefit to one group.
The agenda identifies the resolution as subject to mayoral veto, and the resolution says it takes effect upon final approval. The cityโs posted meeting page showed draft minutes, while the attached resolution copy had blank adoption and mayor-approval fields; those documents do not establish whether final mayoral approval followed.
