Hobbs, Arizona Tribal leaders seek withdrawal of Section 106 proposal
Arizona Gov. Katie Hobbs and Tribal leaders have asked the Advisory Council on Historic Preservation to withdraw a pending proposal to revise federal Section 106 regulations and consult with states and Tribal Nations, the governor’s office said Oct. 12.
The governor’s office page lists 17 Tribal officials alongside Hobbs as signatories. The request is an advocacy letter, not a change to federal requirements. The ACHP said its members voted July 24 to send a draft notice of proposed rulemaking on revisions to 36 CFR Part 800 into interagency review by the Office of Information and Regulatory Affairs, within the Office of Management and Budget, before publication in the Federal Register. The governor’s office said the proposal remained under OIRA review that day.
The office characterizes the proposal as limiting review to areas physically or directly affected by a project and excluding visual or atmospheric effects on cultural landscapes and sacred sites. The ACHP’s announced next step is OIRA review before any proposed rule is published.
