Chattanooga, TN zoning appeals board to consider two setback requests August 5

Chattanooga’s Board of Zoning Appeals is scheduled to consider two setback-reduction variance requests Wednesday, August 5, at the Development Resource Center.

The meeting is set for 10 a.m. in Conference Room 1A at 1250 Market St. The agenda lists cases involving 2402 Awtry Street and 2872 Donna Lane. It also marks a separate drive-through special-exception request at 5943 Hixson Pike as withdrawn by the applicant.

Two setback requests on the agenda

Case BZA-26-41 concerns 2402 Awtry Street. The requested variance would reduce the rear setback from 25 feet to 20.75 feet.

Case BZA-26-42 concerns 2872 Donna Lane. The request would reduce the front setback from 25 feet to 6 feet and the corner-side setback from 15 feet to 6 feet.

Setbacks determine how close construction may be placed to property lines. The agenda lists these as requests scheduled for consideration; it does not establish that either variance has been approved or that a final building or development decision has been made.

Hixson Pike request withdrawn

The agenda lists Case BZA-26-39 at 5943 Hixson Pike as a special-exception request for a drive-through facility in the C-C zoning district. The case is marked “Withdrawn by Applicant,” so it is not an active request for board action on the August 5 agenda.

How the BOZA hearing works

Chattanooga’s Board of Zoning Appeals handles appeals involving zoning administration, along with variances and special permits. The city identifies setbacks, landscaping, parking, building height, zoning-map interpretations and certain special permits among the matters within the board’s authority.

The city’s stated order of business for each case is a staff presentation, applicant presentation, board questions and discussion, community comments, applicant response, further board discussion, and a board motion and vote.

Public comments

Residents and other interested parties who want to submit written comments should email them to ldozoning@chattanooga.gov at least 24 hours before the meeting. The city says comments received less than 24 hours before the meeting cannot be included in the presentation or incorporated into meeting materials.

The August 5 meeting is scheduled to determine the immediate board action on the two listed variance requests. The agenda itself does not report a decision on either case.
